Definition of Terms
In these Conditions, except where the context otherwise requires or where it is otherwise expressly provided, the following expressions have the meanings respectively assigned to them, that is to say: Customer - a person who reserves and/or books one or more Services offered on Website Flightics.com
Booking - any order for selected flights or services on website Flightics.com which is confirmed by Flightics s.r.o. Acceptance will be made when Flightics s.r.o. received full payment from Customer. Then Flightics s.r.o. sent a confirmation email. Final destination - Selected airport according of Customer Booking, which is the last airport on the one-way journey. Customer can order CityBreak by a single Booking, which contains more final destinations. Flight Connection - a flight with an intermediate stop and a change of aircraft (possibly a change of airlines) to reach Customer´s Final destination.
Selected Carrier - The airline with whom the Customer enters into an Contract of Carriage through Flightics services. The airline is due observance of the applicable terms and conditions, is responsible for carrying out the service.
Service Agreement - The purpose of the Service Agreement is to set forth the contractual relationship between Flightics s.r.o. and Customer. On the basis of which Flightic LTD provides the services related to Customer flight(s) to the final Destination with a Selected Carrier for the full price. CityBreak - Form of carriage which includes a combination of Flights which leads to one or more final Destination; or a form of carriage where the Destination and/or the original place of departure are different on Your return journey Contract related information Remain in full compliance with all applicable laws Flightics s.r.o. provides Customer information before entering into the Service Agreement. Services of Flightics s.r.o. shall consist of displaying the offered Flights and their combination on Flightics.com, brokerage of the Contract of Carriage between Customer and the Selected Carrier and delivery of the e-tickets (itinerary), which Customer have purchased during Booking. Customers Agreement with Selected Carrier
For all flights or services booked by Flightics s.r.o. will apply the Selected Carrier´s terms and conditions (including airlines' fare rules). Flightics s.r.o. broker the Contract of Carriage between Customer and a Selected Carrier without unreasonable delay after acceptance payment of the Full Price by Customer. Terms and conditions may include provisions relating to payment procedures, liability, cancellations, changes of bookings and any other restrictions, so Customer is advised to read those terms carefully before the Service Agreement with Flightics s.r.o. A brokered Contract of Carriage can be applied to carriage more than one person or persons others than Customer; however, the Contract of Carriage is always concluded between You (as the person making the Booking) and the Selected Carrier.
Agreement with Flightics s.r.o.
By completing a Booking, Customer enter into the Service Agreement of Flightics s.r.o. and Flightics s.r.o. broker the Contract of Carriage between Customer and a Selected Carrier. Please note that the Service Agreement between You and Us and the Contract of Carriage between You and the Selected Carrier(s) are two separate agreements. Entering into this contract, the Customer agrees (commit) to fullfill obligations resulting from these conditions, and also undertakes to pay the total price to Flightics s.r.o.
No 14-Days Withdrawal Period
Given to the character of Flightics Services, after the conclusion of the Service Agreement, the customer gives instructions for their immediate fulfillment. Before the expiration of the 14-days withdrawal period according to the EU legislation, You shall not withdraw the Service Agreement within 14 days period after its conclusion. The circumstances under which You may withdraw a Service Agreement are explicitly stated in these Terms & Conditions.
Power of Attorney
If the Service is only provided to Customer on the basis of a power of attorney, Customer appoint Flightics s.r.o. as Customer attorney-in-fact and grant all such powers to represent Customer in the extent necessary for the provision of all Services by Flightics s.r.o.
The Full Price are confirmed at the final step of the booking and includes the base fare to the final Destination,fuel and the airport charges, VAT and price of Flightics Services. Other fees, charges or payments for services, which are provided by the Selected Carrier(s) and/or third parties, such as Optional Services, tourist taxes, banking fees, visa fees, airport transfer fees etc are not included. Claim to the brokerage fee arises when Flightics broker the contract of carriage with a Selected Carrier for Customer.
Customer must pay the Full Price with a credit card or by another online payment method listed on website Flightics.com. Customer will need to provide on Flightics.com credit or debit card details in order to cover the full cost of your booking. Flightics will not be liable for any subsequent price increase as a result of payment failure. Any price increase must be paid for by the Customer before the booking can be confirmed.
Storage of Agreements Service agreements with Customers will be store for internal needs and they will not be accessible to public.
All tickets sold by Flightics s.r.o. will be sent to Customer via confirmation emai to Customer email box. Flightics s.r.o. is not liable for faulty delivery or non-delivery of e-ticket(s) for a Flight, if caused by entering an incorrect email address or incorrect email settings. If Customer have not received e-ticket within 48 hours, Customer must contact us via email. Customer must present e-ticket at check-in for the flight. Flightics do not deliver flight tickets in paper form.
If Customer (under these Terms & Conditions) is entitled to receive a refund of the Full Price that paid Flightics s.r.o., the paid Full Price will be refunded to the payment card account that Customer used to pay the Full price; if it is not possible, the refund will be provided by a method mutually agreed between Customer and Flightics s.r.o. within 14 days after the date that Your claim to the refund of the Full Price arises. Flightics cannot anyhow influence the transfer process of the refund and that responsibility solely lies with the financial institutions responsible for remitting the transaction.
Discharge / Extinguishment of Obligations
1. Discharge by Performance – Customer pay the Full price and Flightics provides the Services to Customer. The Service Agreement will be discharged, and the Service Agreement performed.
2. Extinguishment by Default. If Flightics fail to broker the contract of carriage for Customer within 48 hours after paying the Full Price, Flightics will contact Customer and try to offer an alternative solution, or Customer may withdraw from the Service Agreement. If Customer withdraw, Customer will be entitled to a refund of the Full Price. If Customer agree on an alternate flight or another combination of flights to Final Destination, the chargeable Full Price may change. Flightics and Customer will settle the difference between the original Full Price and the new Full Price.
Customer acknowledge that a Selected Carrier’s conditions of carriage will apply to Customer contractual relationship with the Selected Carrier. Customer responsibility is to read condition of carriage before the contract of carriage is concluded. Also each flight may be subject to different rules, especially if operated by a different Selected Carrier.
The Selected Carrier can charge extra fees for additional services, such as selecting the preferred seating, refreshments, etc. Other costs that You may incur during carriage to Final Destination (such as airport transfer fees, visa fees, extra services etc.). These charges are not included in the Full Price. Eventual reimbursement is addressesed to the Selected Carrier.
Customer need to collect luggage and have to personally check it in for the next Flight, when changing planes. Customer responsibility is ensure to catch the relevant flight connection based on all information available at the airport surrounding gate changes, terminals, transit time to gates etc. Flightics is not responsible for any issues arising from missing a Flight Connection and/or taking an incorrect flight.
Flight delay. If Customer miss a Connecting Flight due to a Flight delay (up to 90 minutes), Customer must inform Flightics s.r.o. of such delay as soon as possible. Flightics will offer Customer a reasonable alternative Flight or alternative Transportation to final Destination entirely at Flightics expense up to maximum amount of missed flight and for another one flight to final Destination or Flightics s.r.o. will refund the Customer the price of missed flight and for another one flight to final destination. Guarantee have no claim for flights, where transfer time is planned shorter than 3,5 hours.
Cancellation of flight in advance. Flightics s.r.o. will inform Customer about cancellation in advance and offers Customer solutions for this situation. Customer is obligated to choose one of the options and reply Flightics within 24 hours from receiving email from Flightics. Flightics will arrange another flight to selected destination or refund Customer the price, at Our discretion. If Customer will not answer within 24 hours, claim for Flightics guarantee is not valid anymore.
Cancellation of flight 48 hours before departure. Flightics will search for a reasonable alternative Flight or other means of transportation to Customer Destination on Flightics expenses. If the cost of alternative Flight or other means of transportation is higher than the total cost of allflight tickets, Flightics will agree with the Customer on a partial contribution related to the cost of alternative flights / transportation to the Destination.
Flightics may refund the cost of one overnight accommodation up to 35 Euro per Customer on the day of the occurrence, when their Flight has been delayed or cancelled at short notice and Customer will be stranded at the airport for the night and would need to stay at the airport for more than 8 hours and their alternative Flight connects after midnight.
If due to the Itinerary Change, the Customer will have to spend more than 4 extra hours at the connecting point Flightics may also refund expenses on meals & beverages up to 5 Euro per Customer, in case of spend more than 8 hours at the connectiong point Flightics will refund expenses on meals & beverages up to 10 Euro per Customer. To receive the refund the Customer should present receipt(s) no later than 14 days after the occurrence. The receipt should be send to email firstname.lastname@example.org
If the Customer will make use of an alternative flight from another airport, because all reasonable Flights are sold out or don´t exist connection at the day of departure, Customer has the option to receive an Airport Transfer Fee up to a maximum of EUR 100, which includes all passengers.
In case the airline and/or the airport provides or is obliged to provide the Customer an alternative flight connection or other assistance services, Flightics will be released from the obligation to cover the cost under the Flightics Guarantee. Also the Flightics Guarantee have no claim in case, that Customer make any changes to the schedule of the purchased Flight other than through Flightics s.r.o. Also in order to benefit from Flightics Guarantee, the Customer will be required to cooperate with Flightics during and after the travel has finished – in particular send all requested by customer service documents.
Please note that Flightics Guarantee is limited in cases where such negative event has been caused by force majeure which could not have been avoided (political instability, meteorological conditions incompatible with the operation of the flight concerned, security risks, unexpected flight safety shortcomings and strikes that affect the operation of an operating air carrier). In these cases the respective Carrier bears the responsibility for securing an alternative Flights to Customer.
Other Terms & Conditions
Extra Charges. A Selected Carrier may apply extra charges for extra services. These services are optional, unrelated to Flightics Services, extra charges are not included in the Full Price, must be pay directly to the Selected Carrier. Extra charges are mainly for insurance, checked baggage, priority checking and preferred seats, etc,..
All information supplied by Customer to Flightics s.r.o. must be true, accurate, current and complete. Complete informations are necessary for provision of the Services between Customer and Flightics s.r.o. and also for the conclusion of the Contract of Carriage with a Selected Carrier and must be provide by using Latin script. Flightics is not responsible for any damages, additional cost or any other issues or complications, which may arise as a result of Customer failure or loss caused by force majeure.

All content included on website Flightics.com is property or Flightics s.r.o. or third parties. All software, hardware, processes, algorithms, user interfaces, know-how are part of the society Flightics and it is protected by international copyright and other intellectual property laws. Customer is not granted any rights to ownership of any source code, data, or other technical materials of Flightics s.r.o.. Any use of Content and/or software other than in accordance with this Agreement, including the reproduction, modification, distribution, transmission, republication, display, or performance except as expressly authorised, of the Content on this site is strictly prohibited. The customer also may not modify, copy, or compile software. Certain software and content found on website Flightics.com are owned or licensed by Flightics s.r.o. or third parties, Customer´s use of which may be subject to further conditions.

Passport and Visa
Flightics s.r.o. accept no liability if you are refused entry onto the flight or into any country due to failure on your part to carry the correct passport, visa or other documents required by any airline, authority or country. You must have a passport which is valid for six months after your intended date of return. Customer´s passport must be valid for at least six months after your scheduled return date, in order to avoid having identification or any other issues during your travel.
Liability for Damage
Flightics accepts no liability for any claims, penalties, loss or expenses arising from any actions or omissions of a Selected Carrier or other third parties in connection with carriage to Customer Destination. Flightics s.r.o. is also liable for any damage, harm or loss arising out of Customer actions or omissions that are contrary to these Terms & Conditions or any damage, harm or loss caused by force majeure
Flightics s.r.o. will not charge any extra costs for communicate with Customer via the Internet or over the telephone.
Flightics s.r.o. reserves the right to change or cancel any offered llights if a Selected Carrier’s offer changes or if an error occurred while data processing. If the conditions of carriage are changed by a Selected Carrier, Flightics s.r.o. will notify Customer accordingly and make effort to offer alternative carriage options to Customer.
The contract shall be governed by the laws of England and Wales and any dispute will be dealt with in the Courts of England and Wales.
Changes to General Terms and Conditions
Flightics s.r.o. reserves the right to change or update these Terms and Conditions from time to time without prior notice to Customer.The current version of the T&Cs will be displayed within the Website from the date on which any changes come into effect. Continued use of the Site following any changes to the Terms and Conditions shall constitute your acceptance of such changes.
These Terms and Conditions contain the entire agreement between the parties in relation to its subject matter. If at any time any part of these Terms and Conditions (including any one or more of the clauses of these Terms and Conditions or any sub-clause or paragraph or any part of one or more of these clauses) is held to be or becomes void or otherwise unenforceable for any reason under any applicable law, the same shall be deemed omitted from these Terms and Conditions and the validity and/or enforceability of the remaining provisions of these Terms and Conditions shall not in any way be affected or impaired as a result of that omission.
